Title: Expands the Rights of Temporary Workers
Vote to override a governors veto and pass a bill that expands rights of temporary workers.
Establishes that whenever a firm agrees to send a person to work as a temporary laborer, the firm shall provide a written document in English and the laborer’s primary language containing information about the laborer and details about the labor itself (Sec. 3).
Specifies that in the event of a change in a temporary laborer’s schedule, the firm must provide a written notice regarding the change at least 48 hours in advance (Sec. 3).
Specifies that the Commissioner of Labor and Workforce Development shall implement a multilingual outreach program to inform temporary laborers about their rights (Sec. 3).
Requires a firm to keep specific records when sending one or more temporary laborers to work (Sec. 4).
Prohibits a firm from charging a temporary laborer to transport them to the designated work site (Sec. 5).
Requires that at the time of payment, firms shall provide temporary laborers with an itemized statement on their paycheck stub (Sec. 6).
Prohibits a firm from restricting the right of a temporary laborer to accept a permanent position with a third party client to whom the temporary laborer has been referred for work (Sec. 7).
Limits firms that operate in the state from making designated classification payments unless certified to do so (Sec. 8).
Requires firms to provide third party clients with proof of valid certification issued by the commissioner at the time of entry into a new contract (Sec. 9).
Prohibits firms or third parties from retaliation through discharge or any other manner against a temporary laborer (Sec. 10).
Authorizes a person aggrieved by a violation of this act by a firm or third party to initiate civil action in a superior court in the county where the offense occurred (Sec. 11).
Establishes that the commissioner has the authority to suspend, revoke or refuse to renew any certification that was previously issued (Sec. 12).
