Rep. Ted Budd Sponsors Bill to Increase Access to Affordable Prescription Drugs

Rep. Ted Budd (R-NC) has sponsored H.R. 2883, the Stop Stalling Access to Affordable Medications. This bipartisan bill deems it an unfair method of competition for a brand name drug manufacturer to submit a baseless petition to the Food and Drug Administration (FDA) to attempt to disrupt or delay a generic drug's approval. 

"The bill authorizes the Federal Trade Commission to sue an individual or entity that submits such a petition to the FDA. A party found liable in such a lawsuit shall be subject to civil penalties, such as a fine of up to $50,000 for each day that the FDA spent reviewing the baseless petition."

Rep. Budd said in a statement:

"Taking unfair advantage of the FDA's approval process in order to delay an affordable drug's entry onto the market is wrong and the practice must be stopped. All Americans, especially our seniors, will benefit from an increase in generic drugs on the market."
