Vote Smart's Synopsis:

Vote to pass a bill that authorizes the board of medicine to collect data on maternal mortality in the state of Idaho.

Highlights:

• Require board staff to notify a person that has been undertaken to investigate and allow them to meet with  the committee or board staff before the initiation of formal proceedings by the board (Sec. 1). 

• Authorizes the board to administer oaths, take dispositions of witnesses in a manner consistent with rules adopted by the board and consistent with the administrative procedure act (Sec. 1). 

• Establishes that the board has the power throughout the state of Idaho to require the attendance of witnesses for the production of books, records, and papers as it may deem appropriate for any investigation (Sec. 1). 

• Requires each subpoena to be served and returned in the same manner as a subpoena in a criminal case (Sec. 1). 

• Specifies that district courts are responsible for compelling the compliance of a subpoena in the case that an accused person refuses to testify (Sec. 1). 

• Authorized licensed persons accused in a formal case to engage in the following (Sec. 1):

• Seek injunctive relief prohibiting the unlawful practice of medicine; 

• Make and enter into contracts; 

• Operate and control the licensure of physicians assistance; 

• Develop and submit a proposed budget; 

• Perform other duties set forth in the state; and

• Identifying information necessary for the department of labor to identity workforce shortage areas: 

• Requires the board to collect and review data concerning maternal mortality in Idaho (Sec. 1). 

• Establishes the board must provide an annual summary report no later than January 31 (Sec. 1). 

• Authorizes the bill to take effect on July 1, 2024 (Sec. 2).
