Title: Amending Laws Governing the Disposition of Forefeited Firearms

Vote to adopt a conference report vote and pass a bill that amends laws governing the disposition of forfeited firearms in the state of Maine.

Highlights:

  • Requires that every firearm used by a juvenile or an accomplice during the course of conduct for which the juvenile has been adjusted for a crime that would have been forfeited if the criminal conduct had been committed by an adult be forfeited to the State (Sec. 1). 

  • Establishes that once forfeited to the state the juvenile court shall order another person to satisfy the court prior to the dispositional hearing and by a preponderance of evidence that the other person was the rightful owner of the firearm which was stolen (Sec. 1). 

  • Prohibits a court from ordering the forfeiture of a firearm otherwise qualifying for forfeited  prior to the imposition of the person’s sentence (Sec. 3).

  • Establishes that the Attorney General may adopt rules governing the disposition to state, county, and municipal agencies of firearms forfeited (Sec. 4).

  • Specifies that if a firearm that is forfeited does not meet the prohibition from forfeiture it must be destroyed (Sec. 4).
