Vote Smart's Synopsis:

Vote to pass a bill that establishes a civil penalty for any sale or display of ammunition that allows the ammunition to be accessible to a purchaser or transferee without the assistance of the vendor or an employee of the vendor.

Highlights:

• Requires anyone who desires to engage in the business of selling ammunition to apply to the Department of State to obtain a license to conduct such business and shall pay an application fee of $50 to the Department (Sec. 1). 

• Establishes that the license entitles the holder to conduct business until June 1 of the upcoming year (Sec. 1). 

• Specifies that any licensee who engages in the sale of firearm ammunition must include their initial application and application for renewal of description of their theft and loss prevention policies and procedures as well as their ammunition losses or theft within the prior year (Sec. 1). 

• Prohibits the applicant or licensee’s description of theft and loss prevention policies to become a public record for the purposes of the Freedom of Information Act (Sec. 1). 

• Requires licensees to ensure there is no sale, offer for sale, or display for sale of communication in a manner that would allow it to be accessible to a purchaser without the assistance of the vendor or an employee of the vendor (Sec. 1). 

• Establishes that any violation of this act to be considered a civil offense with the following penalties (Sec. 1): 

• First-time offenses as a penalty of $500; 

• Second-time offenders as deserving of a penalty of $1,000; and

• Third-time offenders an offense of $5,000. 

• Authorizes this act to take effect 1 year after enactment (Sec. 2).
