Title: Prohibits Certain Unlawful Practices by Landlords
Vote to pass a bill that prohibits certain unlawful practices by landlords.
Authorizes the Consumer Protection Unit to commence civil action in any court if a landlord violates or fails to comply with any term in a rental agreement (Sec. 1).
Establishes the following as violations of a rental agreement (Sec. 1):
The violation was not a result of the want of due care by the tennant;
The landlord failed to correct in a timely manner the conditions causing violations; or
The conditions that caused the violation created risk to health, safety, well-being for the tenants.
Authorizes any tenant to petition for a receivership in a Justice of Peace Court beyond 5 days or more, after notifying the landlord, if any state or local statute, code, regulation or ordinance is not being fulfilled (Sec. 2).
Establishes that the filing party has the right to exercise remedies otherwise available to them under common law (Sec. 2).
Requires the Notice to the Director of Consumer Protection of Filed Tennants’ Receivership Petitions to be filled within 10 days and sent a written notice to the Director of Consumer Protection at the Department of Justice (Sec. 3).
