Title: Prohibits Certain Unlawful Practices by Landlords

Vote to pass a bill that prohibits certain unlawful practices by landlords.

Highlights:

  • Authorizes the Consumer Protection Unit to commence civil action in any court if a landlord violates or fails to comply with any term in a rental agreement (Sec. 1). 

  • Establishes the following as violations of a rental agreement (Sec. 1):  

    • The violation was not a result of the want of due care by the tennant; 

    • The landlord failed to correct in a timely manner the conditions causing violations; or

    • The conditions that caused the violation created risk to health, safety, well-being for the tenants. 

  • Authorizes any tenant to petition for a receivership in a Justice of Peace Court beyond 5 days or more, after notifying the landlord, if any state or local statute, code, regulation or ordinance is not being fulfilled (Sec. 2). 

  • Establishes that the filing party has the right to exercise remedies otherwise available to them under common law (Sec. 2). 

  • Requires the Notice to the Director of Consumer Protection of Filed Tennants’ Receivership Petitions to be filled within 10 days and sent a written notice to the Director of Consumer Protection at the Department of Justice (Sec. 3).
