Title: Authorizes the Genetic Information Privacy Act
Vote to pass a bill that authorize the genetic information privacy act.
Specifies that this shall be known as the Genetic Information Privacy Act (Sec. 1).
Specifies that for the purposes of the Genetic Information Privacy act the following definitions are true (Sec. 1):
Biological samples mean any material part of human being that is known to contain DNA;
Consumers mean and individual who is a resident of Nebraska;
Direct-to-consumer genetic testing companies means a company that offers a genetic testing product or collects genetic data that is reported directly to consumers.
Requires a direct-to consumer genetic testing company shall do the following things (Sec. 3):
Provide clear information about the companies data collection policies;
Provide a privacy notice that includes minimum information about how the data will be used and deletion policies;
Obtain a written consent form;
Obtain a written court order before disclosure of genetic data;and
Allow for access to the genetic data by the person.
Specifies that a direct-to-consumer genetic testing company shall not disclose a consumer's genetic data to any entity offering health insurances, life insurance, or long-term care (Sec. 3).
Exempts certain entities from this act due to compliance with state and federal law (Sec. 4).
