Vote to pass a bill that authorize the genetic information privacy act.

Highlights:

• Specifies that this shall be known as the Genetic Information Privacy Act (Sec. 1). 

• Specifies that for the purposes of the Genetic Information Privacy act the following definitions are true (Sec. 1): 

• Biological samples mean any material part of human being that is known to contain DNA; 

• Consumers mean and individual who is a resident of Nebraska; 

• Direct-to-consumer genetic testing companies means a company that offers a genetic testing product or collects genetic data that is reported directly to consumers. 

• Requires a direct-to consumer genetic testing company shall do the following things (Sec. 3): 

• Provide clear information about the companies data collection policies; 

• Provide a privacy notice that includes minimum information about how the data will be used and deletion policies;

• Obtain a written consent form; 

• Obtain a written court order before disclosure of genetic data;and

• Allow for access to the genetic data by the person. 

• Specifies that a direct-to-consumer genetic testing company shall not disclose a consumer's genetic data to any entity offering health insurances, life insurance, or long-term care (Sec. 3). 

• Exempts certain entities from this act due to compliance with state and federal law (Sec. 4).
