Vote to pass a bill that authorizes remote participation of any party in a county court residential eviction filing effective January 1, 2024.

Highlights:

  • Specifies how the general assembly finds that many renters face significant barriers to appearing in court for an eviction in person which the assembly wishes to remediate through remote proceedings (Sec. 1). 

  • Requires the courts to allow either party and any witness to make a court appearance either in person or remotely by phone or video on a court designated and allowed platform as well as to file documents with an e-filing system (Sec. 2).

  • Specifies that the court shall comply with any federal or state law or regulation regarding the provision of accommodations for people with a disability or limited English proficiency (Sec. 2). 

  • Specifies how the court must provide for reasonable efforts to contact the parties if either are disconnected for technical reasons (Sec. 2).

  • Specifies that the court shall provide the plaintiff with any necessary information to facilitate the plaintiffs participation in the court proceedings (Sec. 3). 

  • Specifies this act goes into effect on January 1st 2024 (Sec. 7).
