Title: Establishes Provisions Regarding Prosecuting Attorneys
Vote to pass a bill that establishes provisions and regulations for prosecuting state district attorneys.
Establishes a Prosecuting Attorneys Qualifications Commission within the state legislature and authorizes them the power to discipline, remove, and cause involuntary retirement of appointed or elected district attorneys or solicitors-general (Sec. 2).
Specifies the commission shall consist of 8 members broken into a 5 member investigative panel and a 3 member hearing panel (Sec. 2).
Authorizes the following reasons as grounds for discipline or removal of a district attorney or solicitor general, including, but not limited to (Sec. 2):
Mental or physical incapacity interfering with performance of their duties;
Willful misconduct in office;
With respect to district attorneys and solicitor generals, willful and persistent failure to carry out duties;
Conviction of a crime involving moral turpitude; or
Conduct prejudicial to the administration of justice.
Specifies that this bill shall take effect immediately upon its passage and approval by the governor (Sec. 5).
