Title: Amends Definitions of Machine-Guns for Increased Felony Penalties

Vote to pass a bill that amends the definition of "machine-guns" for increased felony penalties.

Highlights:

  • Specifies that organized retail theft is the act of directly or indirectly selling the property of a retail merchant without their authorization (Sec. 8) 

  • Classifies organized retail theft as a level 6 felony (Sec. 8) 

  • Classifies  organized retail theft as a level 5 felony if one of the following is true (Sec. 8):

    • The value of the property is at least $50,000; 

    • The property is a firearm; or 

    • The person has a prior conviction of organized retail theft , theft, and criminal conversion

  • Authorizes the disclosing of sealed documents records to a school for the following purposes (Sec. 6): 

    • Determining whether to employ a person (including volunteer employment); 

    • Determining whether to continue a person's employment  (including volunteer employment); and 

    • Determining whether to grant an independent contractor admission to the school if the independent contractor will come into contact with students (regardless of the student's age).  

  • Repeals the requirement that a prosecuting attorney or deputy prosecuting attorney needs to obtain a proper seal to perform certain duties (Sec. 1). 

  • Repeals the rule that all acts not attested to by the proper seals are void (Sec. 1).
