Title: Requires Businesses Design and Implement a Safety Preparedness Plan
Vote to pass a bill that requires businesses to design and implement a safety preparedness plan to resume business operations during the COVID-19 pandemic.
Establishes orders and rules promulgated by the governor, when approved by the Executive Council and filed in the Office of the Secretary of State, have, during a national security emergency, peacetime emergency, or energy supply emergency, the full force and effect of law. Rules and ordinances of any agency or political subdivision of the state inconsistent with the provisions of this chapter or with any order or rule having the force and effect of law issued under the authority of this chapter are suspended during the time and to the extent that the emergency exists (Sec. 1).
Requires any executive order relating to a public health emergency for an infectious disease that closes or partially closes or proposes to close or partially close a business to ingress, egress, use, and occupancy by members of the public must (Sec. 2):
Be approved by the legislature with a simple majority vote in both the Senate and the House of Representatives acting separately before implementation of the executive order; and
Provide businesses subject to the executive order with 14 calendar days advanced notice of the closure.
Authorizes a business closed to ingress, egress, use, and occupancy by members of the public to fully operate with no capacity limitations provided that the business (Sec. 3):
Develops a COVID-19 safety plan, which shall provide site-specific best practices for the business including, but not limited to, health and wellness; social distancing; cleaning, sanitation, and protection; and operations and communications for employees and members of the public; and
Makes a good faith effort to maintain a safe and healthful workplace and business operation. No board or licensing agency may impose any additional penalties for a violation of the governor's emergency executive orders.
