Vote Smart's Synopsis:

Vote to pass a bill that classifies abortions specifically for a fetus with a genetic abnormality as a class 3 felony.

Highlights:

• Defines “genetic abnormality” as the presence or assumed presence of an abnormal gene expression in an unborn child, including a chromosomal disorder or morphological malformation occurring as the result of abnormal gene expression (Sec. 1.G-2).

• Specifies that an unborn child at every stage of development is entitled to all the privileges and immunities available to other persons and citizens (Sec. 1) 

• Classifies the following as a class 3 felony, except in the case of a medical emergency (Sec. 2): 

• Performing an abortion knowing that the abortion is sought based on the sex or race of the child or the race of a parent of that child; and

• Performing an abortion knowing that the abortion is sought based on the genetic abnormality of the child 

• Classifies the following as a class 3 felony (Sec. 2):

• Uses force or the threat of force to intentionally injure or intimidate any person to coerce sex-selection or race-selection abortion, or an abortion because of a genetic abnormality of the child; and

• Solicits or accepts monies to finance a sex-selection and race-selection abortion or abortion because of a genetic abnormality of the child.
