Title: Reduces Criminal Penalties for Marijuana Possession
Vote to pass a bill that reduces criminal penalties for marijuana possession, effective July 1, 2019.
Requires an individual who violates the prohibition of the possession of marijuana by up to one-half ounce of marijuana to be issued a penalty assessment and is subject to a fine of $50 (Sec. 1).
Requires an individual who violates the prohibition of the possession of marijuana by more than one-half ounce but less than one ounce of marijuana is, for the first offense, to be guilty of a petty misdemeanor and will be fined not less than $50 or more than $100 and by imprisonment for no more than 15 days (Sec. 1).
Requires an individual who violates the prohibition of the possession of marijuana by more than one-half ounce but less than one ounce of marijuana is, for the second or subsequent offense, to be guilty of a misdemeanor and will be fined not less than $100 or more than $1000, or by imprisonment for a definite term of less than one year, or both (Sec. 1).
Requires an individual who violates the prohibition of the possession of marijuana by more than one ounce but less than eight ounces of marijuana to be guilty of a misdemeanor and will be fined not less than $100 or more than $1000, or by imprisonment for a definite term of less than one year, or both (Sec. 1).
Requires an individual who violates the prohibition of the possession of marijuana by eight ounces or more of marijuana to be guilty of a fourth degree felony and will be sentenced to of 18 months imprisonment, a $5000 fine, or both (Sec. 1).
