Title: Amends Prison Parole Laws

  • Requires the parole board to provide objective, evidence-based reasons for denial of parole (Sec. 33).

  • Limits objective reasons to the following circumstances, including, but not limited to (Sec. 33):

    • A prisoner exhibits behavior that indicates a potential risk to public safety;

    • A prisoner refuses to participate in required programs intended to reduce his/her risk; or

    • A prisoner threatens to harm another person upon release.

  • Authorizes the parole board to defer parole for up to 1 year to allow for completion of programming intended to reduce a prisoner’s risk to public safety (Sec. 33).

  • Requires the parole board to annually report information regarding the number of prisoners denied parole to Committees of the Senate and the House of Representatives (Sec. 33).

  • Specifies that there is no entitlement to parole (Sec. 35).

  • Requires the parole board to provide a prisoner with a written explanation of the reason for denial of parole (Sec. 35).
