Title: Limits Applicability of Disability Lawsuits
Vote to concur with House amendments and pass a bill that establishes requirements for disability lawsuit claims against businesses, allowing businesses 30 days to fix violations.
Establishes requirements for filing a civil action against a business or private entity that has allegedly violated a law related to accessibility or discriminated against an individual with a disability (Sec. 1).
Requires the aggrieved person or their attorney to provide the private entity with a written notice containing sufficient detail about the violation before they can file a civil action to allow the private entity to identify and cure the violation or comply with the law (Sec. 2).
Requires that within 30 days of receiving written notice about a violation, a private entity must supply the aggrieved person or their attorney with a corrective action plan (Sec. 2).
Requires that within 30 days of receiving written notice about a violation, a private entity must also obtain any governmental approvals or permits needed in order to make the required changes or comply with the law (Sec. 2).
Specifies that the aggrieved person may not file a civil action for an additional 60 days from the date that the private entity provided them with a corrective action plan (Sec. 2).
