Title: Authorizes the Use of Medicinal Marijuana

Vote Smart's Synopsis:

Vote to pass a bill that authorizes medicinal marijuana use, effective July 1, 2016.

Highlights:

  • Authorizes an individual to obtain a medicinal marijuana card if the individual meets the following conditions (Sec. 34):
    • The individual is at least 18 years old;
    • The individual is a Utah resident;
    • The individual submits a physician’s recommendation stating that the individual suffers from a qualifying illness; and
    • The individual pays the application fee; and submits the application to the Department of Health.
  • Specifies that the conditions that constitute a “qualifying illness,” including, but not limited to, the following conditions (Sec. 47):
    • Epilepsy;
    • Side effects of chemotherapy;
    • Appetite stimulation;
    • Muscle spasticity or a movement disorder; and
    • Certain neuropathic pain conditions.
  • Requires an individual in possession of medicinal marijuana to carry their medicinal marijuana card with them at all times (Sec. 37).
  • Authorizes the production of medicinal marijuana in the following forms (Sec. 19):
    • A tablet;
    • A capsule;
    • A concentrated oil;
    • A trans-dermal preparation; or
    • A sub-lingual preparation.
