Vote to pass a bill that requires an individual arrested for certain crimes to submit a DNA sample.
Highlights:
Requires an individual accused of committing certain offenses including, but not limited to, the following offenses, and after a finding of probable cause for detention or upon an arrest on a felony arrest warrant, to submit to deoxyribonucleic acid (DNA) testing and provide a blood or saliva sample to the arresting authority (Secs. 1 & 2):
First degree or second degree murder;
First degree robbery;
First degree rape; or
Child abuse.
Requires the accused individual to pay a $15 fee for submission of the sample to the Oklahoma State Bureau of Investigation (OSBI) Combined DNA Index System (CODIS) Database (Sec. 1).
Prohibits previously convicted or arrested individuals who have a “valid” DNA sample on file in the OSBI CODIS Database from being required to submit to additional testing (Sec. 1).
